GENERAL CONDITIONS OF SALE

1. GENERAL

1.1. These general conditions of sale regulate all the modalities and forms of contracting for the sale of the products manufactured and marketed by IBERINA TECNOLOGIA DIAMANTES SL unless otherwise agreed by means of a particular written agreement signed by the buyer and IBERINA TECNOLOGIA DIAMANTES SL

2. ORDER CONDITIONS

2.1. The client can place their orders to IBERINA TECNOLOGIA DIAMANTES SL by phone or email.
2.2. The order will be confirmed when you receive the confirmation order, thus accepting the GENERAL CONDITIONS OF SALE.
2.3. The order confirmation is considered a contract and a commitment to purchase the material described therein.

3. PAYMENT CONDITIONS

3.1. The tools and machinery supplied will remain the property of IBERINA TECNOLOGIA DE DIAMANTES SL until payment in full.
3.2. The Client will proceed to pay the invoices issued by IBERINA TECNOLOGIA DIAMANTES SL within 30 days of their issuance by bank transfer. If terms or payment methods other than those provided in the general conditions of sale are negotiated, they will prevail, these changes being reflected in the corresponding invoices.
3.3. In the event of non-compliance with the payment term provided in clause 3.1 or the one specifically agreed with the Client, IBERINA TECNOLOGIA DIAMANTES SL reserves the right to claim the default interest accrued in application of article 7 of Law 3/2004 of December 29 to combat late payment, compensation for the expenses that have arisen in application of article 8 of the aforementioned Law, as well as the expenses for the return of bank items, if any.
3.4. IBERINA TECNOLOGIA DIAMANTES SL reserves the right to apply discounts on the prices that have been agreed with the Client, such as not to supply products, if the Client fails to comply with its payment obligations.
3.5. In the event of non-payment by the Client, IBERINA TECNOLOGIA DIAMANTES SL reserves the right to communicate this circumstance to the entities dedicated to the provision of information services on breach of monetary obligations, in accordance with the provisions of article 29 of the Law Organic 15/1999 of December 13, Protection of Personal Data, the Client expressly accepting the communication of their data for these purposes and the consequences that may arise from said measure.

4. RATES AND PRICES

4.1. IBERINA TECNOLOGIA DIAMANTES reserves the price change without prior notice due to unforeseen events. The causes can be errors in calculation, printing, variations in order units or changes in dimensions and design.
4.2. The prices of IBERINA TECNOLOGIA DIAMANTES SL products are reflected in our current price rates and are available through written estimates or from our authorized agents.
4.3. Prices are reflected, if no other type of currency is agreed, in Euros and do not include VAT.
4.4. The validity of the estimates is 30 days from the date of issue.
4.5. Cash payments will obtain an additional discount of 3% of the total net amount (Without VAT).
4.5. The revision for repair or maintenance of machinery or tools out of warranty, will have a cost of € 80, in case of not accepting the corresponding budget.

5. SHIPPING AND DELIVERY TIME

5.1. IBERINA TECNOLOGIA DIAMANTES SL will charge the cost of packaging and transport on the invoice, if it has not been agreed otherwise.
5.2. When the order exceeds the amount of € 350 (not including VAT) and is considered by IBERINA TECNOLOGIA DIAMANTES SL as standard products, the cost of packaging and transport will be borne by the same.
5.3. The products will be delivered at the place indicated by the Customer in the contract or at the place indicated in each order.
5.4. In the event that IBERINA TECNOLOGIA DIAMANTES SL pays the postage, it reserves the free choice of agency and type of transport contracting.
5.5. In the event that the Client bears the transport costs, the transport agency will be of their free choice.
5.6. IBERINA TECNOLOGIA DIAMANTES will be in charge of insuring the merchandise during transport, it is covered with the minimum mandatory insurance of the transport agency.
5.7. IBERINA TECNOLOGIA DIAMANTES is not responsible for merchandise damaged or lost during transport.

6. CANCELLATION AND RETURN OF ORDERS

6.1. The return of material must be notified to IBERINA TECNOLOGIA DIAMANTES SL in writing. In the event that the return is accepted, IBERINA TECNOLOGIA DIAMANTES will draft the admission according to the corresponding conditions, accepting it.
6.2. The customer must pack correctly and return the merchandise, taking charge of the transport costs.
6.3. The return of the material must be made within a maximum period of 7 business days once the return has been accepted.
6.4. Once IBERINA TECNOLOGIA DIAMANTES SL receives the returned material, the status of the merchandise will be evaluated and verified.
6.5. IBERINA TECNOLOGIA DIAMANTES SL will not accept the return of orders that present any of the following characteristics:
- Damaged packaging
- Discontinued products
- Custom products
- Purchase promotions for incomplete quantities or kits
- Tools with wear greater than 1 mm.

7. LIABILITY

7.1. The Client is responsible for the correct use and handling of the machines and tools supplied by IBERINA TECNOLOGIA DIAMANTES. The company is not responsible for personal or material damage caused by improper handling of the products.

8. GUARANTEE OF GOODS AND SERVICES

8.1. IBERINA TECNOLOGIA DIAMANTES SL, in accordance with current law, guarantees the repair or replacement at no cost of all tools and machinery as a result of a manufacturing defect during the useful life of the product. Repair includes labor and repair or replacement of defective components until proper operation.
8.2. Products that show misuse or blows will be excluded from the guarantee.

9. INTELLECTUAL AND INDUSTRIAL PROPERTY

9.1. All the intellectual and industrial property rights associated with the products and services are registered under the IBERINA TECNOLOGIA DIAMANTES SL brand, so they do not grant the Client any right of use.

10. PRIVACY

10.1. IBERINA TECNOLOGIA DIAMANTES SL is responsible for the treatment of the data provided by its clients, the purpose of which is to provide correct commercial management in accordance with the Personal Data Protection regulations, Organic Law 15/1999, of December 13, Data Protection of Personal character.
10.2. IBERINA TECNOLOGIA DIAMANTES SL will process the data obtained to send different types of commercial communication and manage queries. Clients may register, cancel or modify their data upon request by email.

11. JURISDICTION AND JURISDICTION

11.1. These General Conditions will be governed by Spanish law.
11.2. Failure to comply with the conditions of commitment will be treated with express waiver of the jurisdiction that may correspond to the Client and will be submitted to the courts of Almería, to settle any litigation or controversy.

12. MODIFICATIONS

12.1. IBERINA TECNOLOGIA DIAMANTES SL may modify these General Conditions at any time.
12.2. The modifications made to the General Conditions will enter into force for new transactions when the client places orders for products and services after the update of the General Conditions. In case of disagreement with the new general conditions, the client must refrain from placing new orders for products or services.
